Establishment of Hearing Committee

Be it hereby resolved that the Delegate Assembly of LSSA hereby creates a Hearing Committee whose purpose it shall be to set up a mechanism and hold hearings to determine fines, penalties and other appropriate discipline, if any, against scabs for conduct unbecoming a Union member. Such fines shall be reasonable and in no case shall exceed a full day's pay for every day of scabbing.

Such committee shall be composed of equal numbers of legal workers and attorneys, with full representation give to Third World and women employees. The Committee on Scabs shall solicit a list of volunteer hearing officers, from which list they will select 10 officers and an equal number of alternates. Said selections shall be confirmed by the Delegate Assembly. Said committee shall also select representatives to present the Union's position at the hearings.

No member of the Committee who is from the same office as one particular scab shall sit on that particular hearing.

All other mechanisms and procedures shall be determined by the Scab Committee in conjunction with the Hearing Officers and shall be reasonable and fair, consistent with the scab's right to be heard.

Final reports from the Hearing Committee must be confirmed by Delegate Assembly in accordance with the Constitution and Bylaws.
